This website is operated by Dustin Kendall. By using it, you accept these terms. If you don't accept them, don't use the site — though I'd rather you just emailed me with your concern.

What this site's content is — and isn't

Everything published here (pages, case studies, writing, the résumé) is general information about engineering services and past work, provided "as is" without warranties of any kind. Specifically:

• It is independent engineering guidance — it is not legal advice, not financial advice, and not a certified security audit, attestation, or compliance certification of any framework (SOC 2, PCI DSS, HIPAA, or otherwise). Certifications come from licensed professionals and accredited auditors.
• Reading this site, booking a call, or exchanging email does not create a client relationship or any duty of engagement. Work begins only under a signed statement of work.
• Case-study metrics reflect real past work, sanitized and rounded; past results are not a guarantee of your results.

Engagements

Paid engagements are governed exclusively by their own signed agreement (statement of work and terms), which supersedes these website terms for that work. Any guarantee described on this site — including the Cloud Cost Reduction savings guarantee — applies only on the full terms set out in that engagement's statement of work, which controls.

Intellectual property

Site content is © Dustin Kendall. You may link to it freely and quote it with attribution; don't republish substantial portions without permission.

External services and links

Booking runs on Cal.com and links may point to external sites. I don't control those services and am not responsible for their content or terms.

Limitation of liability

To the maximum extent permitted by law, Dustin Kendall is not liable for any damages arising from your use of this site or reliance on its content. Your sole remedy for dissatisfaction with the site is to stop using it.

Governing law

These terms are governed by the laws of the State of Tennessee, USA, without regard to conflict-of-law rules.

General

If any part of these terms is found unenforceable, the rest still applies. My not enforcing a term on one occasion doesn't waive it. For use of this site, these terms are the entire agreement between us; for paid work, the signed engagement agreement is.

Changes

Updated terms are published here with a new effective date and apply from that date forward.
